Car Accidents
Florida Car Accident Lawyers
A car crash can turn an ordinary day into a medical, financial, and logistical crisis. While you are arranging treatment, transportation, childcare, and time away from work, insurance companies are already investigating the claim. They may request a recorded statement, search for prior medical conditions, question treatment, or try to shift responsibility.
The Dellutri Law Group, PA helps injured drivers, passengers, pedestrians, and families understand what to do next. Our Florida car accident lawyers preserve evidence, evaluate insurance coverage, manage claim communication, and pursue compensation tied to the full impact of the crash.
What to Do After a Florida Car Accident
- Call 911 and request medical assistance when needed.
- Move to a safe location if it can be done without creating further danger.
- Exchange identifying and insurance information, but do not argue about fault.
- Photograph vehicle positions, damage, road conditions, traffic controls, skid marks, injuries, and the surrounding area.
- Collect witness names and contact information.
- Obtain the crash-report information and preserve all related documents.
- Seek medical evaluation promptly, even when symptoms appear manageable at first.
- Notify your insurer as required, but consider legal advice before providing a detailed recorded statement.
- Avoid social-media posts about the crash, injuries, activities, or claim.
Florida PIP and the 14-Day Medical Rule
Florida's motor-vehicle insurance system generally requires personal injury protection, commonly called PIP. Subject to policy terms and statutory limits, PIP may provide medical and disability benefits without first deciding who caused the crash.
Initial medical services generally must be received within 14 days after the accident for PIP medical benefits to apply. The available amount may depend on whether an authorized provider determines that an emergency medical condition exists. Because coverage questions can become complicated, prompt treatment and careful review of the policy are important.
When a Claim Can Go Beyond PIP
PIP does not resolve every loss. Serious injuries may permit a claim against an at-fault driver or another responsible party. Claims may also involve property-damage coverage, bodily-injury liability coverage, uninsured or underinsured motorist coverage, commercial policies, rideshare policies, or other sources.
The identity of the responsible parties and available coverage can be as important as the injury itself. A collision involving a company vehicle, delivery driver, defective component, roadway condition, or negligent vehicle owner may require a broader investigation.
Common Causes of Florida Car Crashes
- Texting, telephone use, navigation, and other forms of distracted driving.
- Speeding or driving too fast for traffic and weather conditions.
- Drunk or drug-impaired driving.
- Following too closely and unsafe lane changes.
- Running red lights or stop signs and failing to yield.
- Drowsy driving.
- Unsafe turns, intersection errors, and failure to check blind spots.
- Poor vehicle maintenance, tire failure, brake problems, or defective parts.
- Dangerous road design, construction zones, or inadequate maintenance.
How Fault Is Established
A negligence claim generally requires proof of duty, breach, causation, and damages. Evidence can include the crash report, scene photographs, vehicle damage, surveillance or dash-camera video, electronic vehicle data, cell-phone records when legally obtainable, witness statements, medical records, and expert analysis.
Florida's modified comparative-fault rule can reduce a recovery by the injured person's percentage of responsibility. In most negligence cases, a person found more than 50 percent responsible for their own harm may not recover damages. Insurers know this and may try to create a fault dispute immediately.
Damages in a Car Accident Claim
- Emergency care, diagnostic testing, surgery, therapy, medication, and future treatment.
- Lost wages and reduced earning capacity.
- Vehicle damage, rental costs, transportation expenses, and other documented losses.
- Pain, disability, scarring, emotional distress, and loss of enjoyment of life.
- Family-related damages when recognized by Florida law.
- Wrongful-death damages when a crash causes a fatal injury.
Why Early Legal Involvement Matters
Evidence changes quickly after a crash. Vehicles are repaired, video is overwritten, witnesses become harder to find, and memories fade. Early representation can help preserve evidence, locate coverage, document the claim, and prevent the injured person from being pressured into a premature settlement.
An insurer may offer money before the medical prognosis is clear. Accepting a settlement usually requires signing a release. Once signed, the release may prevent any further recovery even if surgery, long-term disability, or future care becomes necessary.
